The following Terms and Conditions apply to your use of the online Coach2Competence & Multi SkillZ programs powered by Coach2Competence BV (C2C) available at www.multiskillz.com and www.coach2competence.com. When ‘C2C’ is used in these Terms and Conditions, this applies for both the Coach2Competence & Multi SkillZ websites, online programs and App.

For every individual C2C program there are specific Terms of Use. These Terms & Conditions and the Terms of Use for a specific program form a legally binding agreement between you and Coach To Competence in relation to your use of the C2C platform and programs with associated Apps. It is important that you take time to read them carefully.

In addition to our legal terms and conditions, you may also find it helpful to visit the Coach2Competence website page for more information or you can contact us by email at info@coach2competence.com or by phone at +32 485 74 73 18.
In case of any discrepancy between the Dutch and other versions of these Terms & Conditions, or any other content within the Website, the Dutch version shall prevail.

  1. Introduction
  2. The Multi SkillZ and Coach2Competence websites are owned and operated by Coach2Competence BV (Belgium) ("C2C") of Klokkeputstraat 102, 8800 Roeselare, Belgium. Our company registration number is 547639333, and VAT number BE0547.639.333.
    These Terms & Conditions were last updated on May 22nd 2018 and replace all previous terms & conditions for www.coach2competence.com and www.multiskillz.com. If we need to update these terms & conditions for any legal or regulatory reasons, or if we change the nature of the services offered, we will post the most recent version here and inform any registered users of the changes by email.

  3. Privacy
  4. Acceptance of these Terms & Conditions amounts to full acceptance of the use and the processing by us and our nominated third parties of your personal data in accordance with the Privacy Policy. Please see our Privacy Policy, which is part of these Terms & Conditions, for further details.

  5. Registration
  6. Some pages on multiskillz.com and coach2competence.com are free to view, but to gain access to the C2C online support program and/or App, you will need to be registered with a Coach2Competence ID and pay a membership registration fee. In some cases free access can be granted. In this case these Terms & Condition apply as well.
    Your C2C registration is not transferable and you may not allow your Coach2Competence ID be used by another person.
    C2C reserves the right, at its absolute discretion to refuse any registration application or renewal. C2C also reserves the right to suspend or cancel at any time and without notice the registration of any person who is found to have been in breach of these Terms & Conditions.

  7. Your Account
  8. You are responsible for maintaining the confidentiality of your Coach2Competence ID account and password details and for restricting access to your computer to prevent unauthorised access to your account.
    You may not transfer your account to anyone else.
    You should take all necessary steps to ensure that your password is kept confidential and secure at all times and should inform C2C immediately if you have any reason to believe that your password has become known to anyone else, or if your Coach2Competence ID is being, or is likely to be, used in an unauthorised manner to access your account and programs.

  9. Your Safety and Disclaimer
  10. The use of the C2C is entirely at your own risk.
    The information at this Website is provided by Coach2Competence and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
    The information is presented for the purpose of educating participants on coaching and playing of various sports, and participation in various physical activities. No physical activity should be engaged in without first consulting a physician.
    Any specific activities, drills, products, or procedures that may be mentioned on the Websites are for information purposes only. You rely on any information provided by C2C, its sponsors and advertisers, or other visitors to the Website at your own risk.
    Furthermore, C2C makes no claims about the safety or appropriateness of any information found on the Website, nor about the results to be obtained from using the Coach2Competence & Multi SkillZ website and consequently cannot be liable for any resulting loss, damage or injury arising from any use of any product, information, idea, or instruction presented on the Websites.
    Every effort is made to keep the website up and running smoothly. However, Coach2Competence no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

  11. C2C Memberships, Payment Plan, Withdrawal and Cancellation
  12. To use the C2C Program service you must have Internet access and provide us with a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to activate your Membership.

      • Membership
        • Free Drills. With a valid C2C account, you may have access to free available videos with exercise, Free Drills. Access to these Free Drills does not mean you have a Membership. A valid C2C account gives you free access to these Free Drills.
        • Differing Memberships. We may offer a number of membership plans, including special promotional plans or memberships with differing conditions and limitations. Any materially different terms from those described in these Terms of Use will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your Program membership by logging in with your C2C account to one of our websites and clicking on the "My Memberships" link.

          Some promotional memberships may be offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate or otherwise amend our offered membership plans.

        • Free Trials. Your  membership may start with a free trial. The free trial period of your membership for a Program lasts for one month, or as otherwise specified in the conditions of the C2C Program you purchase. For combinations with other offers, restrictions may apply. Free trials are for new and certain former members only. C2C reserves the right, in its absolute discretion, to determine your free trial eligibility.

          At the end of the Free Trial period, your Membership may be automatically be renewed in a paying Membership linked to a Payment Plan (see below). In this case we will begin billing your Payment Method for the membership fees as specified in the conditions of your Program at the end of the Free Trial period. The specific details of your membership, including Payment Plan, Price and end date of your free trial period will be send to you by email to the email address of your registration the day of the activation of your Membership.
          You will not receive a notice from us that your free trial period has ended or that the paying portion of your membership has begun. To view specific details of your Membership, including the status and the price of your Membership and the date of the next payment, you can visit the section ‘My Memberships’ on our website after being logged in.

      • Payment Plans
        • Payment Method. We will inform you of any applicable fees before you are charged for such fees and, by providing your billing information, you agree that you are liable for payment of such fees. You expressly authorise C2C (or third parties acting on behalf of C2C) to charge all C2C registration fees and other charges, including VAT if applicable, and including payment transaction fees for certain payment methods, to the payment method you have designated.

          You can pay via the online payment methods available to you on the Websites. Online payment is provided via Mollie (https://www.mollie.com). All payment and card details are processed over a secure connection to Mollie and are encrypted at all times. Your credit/debit card details will not be passed to C2C nor to any 3rd party.

          Membership fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular, if your Payment Method has not successfully settled. If a payment cannot be charged because it has expired, or because the balance is too low, and you do not update your Payment Method or terminate your account (see "Cancellation" below), you will owe the unpaid amounts. You authorize us to continue billing your Payment Method, even after it has been updated. This can lead to a change in the billing date for your payments. In certain cases, Mollie may charge currency or other charges. For more information, contact Mollie (www.mollie.com) yourself.

        • Membership Fees and Prices. The applicable Payment Plan for the Program you want to purchase and its corresponding Membership Fees will be explained on the program webpage.

          The Prices shown before clicking ‘Subscribe’ will be the amounts charged to your Payment Method. These prices presented include all taxes, commissions, costs and VAT. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes to your service will take effect no earlier than 30 days following email notice to you.

          Please check the specific Payment Plan offered for a specific program on our Websites carefully before activating your membership and corresponding Payment Plan. A Payment Plan can exist of a Single Payment, Periodic Recurring Payment or a combination of a both.

        • Single Payments.  For some programs you may be offered a Single Payment for you membership. This is a one-off payment on the day corresponding to the commencement of your membership followed by a well-defined access duration or continuous access until cancellation of the program.
        • Periodic Recurring Payments. In a Recurrent Payment we will charge your Payment Method starting from the date mentioned in your Payment Plan periodically. Recurring payments can run, for example, monthly, quarterly, annual, ... Your membership will automatically be renewed periodically upon each periodic payment. We continue billing your membership fee to your Payment Method for each period unless and until you cancel your membership or we terminate it.

          You must cancel your membership before it renews each period in order to avoid billing of the next period’s membership fees to your Payment Method. You will not receive notice from us that your periodic payment is billed to your Payment Method.

          In the event of a Monthly Recurring Payment, and your Payment Plan began on a day not contained in a given month, we may bill your Payment Method on a day in the applicable month or such other day as we deem appropriate. For example, if you started your Monthly  Recurring Payments on January 31st, your next payment date is likely to be February 28th, and your Payment Method would be billed on that date. Your renewal date may change due to changes in your Membership. We may authorize your Payment Method in anticipation of membership or service-related charges.

          As used in these Terms of Use, "billing" shall indicate a charge, debit or other payment clearance, as applicable, against your Payment Method.

        • Start-up Payment, Entry Period and Extension.  A Payment Plan may consist of a one-off Start-up Payment followed by payment free Entry Period. We will bill this Start-up Payment to your Payment Method before the commencement of your access and beginning of your Entry Period. Your access will be granted during the Entry Period without further payment.

          At the end of your Entry Period, your membership will be automatically renewed into an ongoing membership with Periodic Recurring Payments (see above). Your membership access will continue automatically after each Recurring Payment for a certain period of time, called Extension. As used in our Terms and Conditions, an "Extension" shall indicate a periodic extension of your membership after a charge, debit or other payment clearance, as applicable, against your Payment Method.

        • No Refunds. Payments are non-refundable and there are no refunds or credits for partially used periods, unwatched videos or digital materials that where not downloaded. Following any cancellation, however, you will continue to have access to your personal C2C program through the end of your current billing/extension period.

     

      • Right of Withdrawal. When you request to purchase a service on this Website, such a request amounts in law to an offer only to purchase at the stated amount. No binding contract in law is formed until such time as a confirmation e-mail is sent by C2C to your specified e-mail address in which it is stated that such offer is accepted.

        You provide your explicit consent to the immediate commencement of your membership when you click Subscribe during sign-up, which allows you to enter your purchased C2C program. A confirmation email will be send to you and you will be redirected within 10 seconds to the webpage to enter your personal C2C program. After this point you cannot, except as provided under the laws of the right of withdrawal, abandon your purchase.

        By law, customers in the European Union have the right to withdraw from the purchase of a service sold at a distance. You must tell us in writing by use of the C2C Withdrawal Form if you wish to withdraw. The time limit for withdrawal varies according to EU jurisdiction, in Belgium it is within 14 days beginning with the day the product is delivered to you.

        During a membership with Periodic Recurring Payments or Extension you will receive an email after each periodic payment to inform you that your membership is renewed and you will have extended access to your C2C program. You acknowledge that after receiving this email you lost your right to withdrawal for the upcoming membership period, but this does not affect your right to cancel your C2C program membership at any time.
         

      • Cancellation. You may cancel the C2C program Membership at any time. During your membership all database of videos, documents, digital materials and information of the program remain available to you after logging in with your Coach2Competence ID on our Websites. After cancellation of your Membership you will continue to have access to your personal C2C program through the end of the current membership period. Once this membership period is over your access to your C2C program will no longer be granted. In this case, you need to renew your membership, possibly via an Extension, to regain access to your program.

        To cancel, go to the "My Account/Memberships" after logging in on one of our Websites and click the ‘Cancel’ button of your program. This Button will be available for you 1 month before the end of the Entry Period of your Membership. If you cancel your membership, your account will automatically close at the end of your current billing period.

  13. C2C program Service
      • Access to this website for Children Under 16. If you are under 16, you must ask your parents or a guardian before you:
        • E-mail the Website, or ask C2C to e-mail anything to you
        • Send in any information to C2C or register for a Coach2Competence ID or register for a C2C subscription
        • Enter any contest or game that requires information about you or offers a prize, or
        • Buy or pay for anything online.
        • By continuing to use this Website, you are confirming that you have obtained the consent of your parents or legal guardian.

      • We continually update the Coach2Competence and Multi SkillZ Websites, including the content library. As a member you get access to a C2C program webpage with exercise videos and possibly education video’s and tutorials. Check the information webpage of a program to see what you get. We reserve the right in our sole and absolute discretion to make changes from time to time in how we offer and operate our Service. We have the right to stop providing and/or supporting any of our Services (including any program or part of any program offered by us) at any time either permanently or temporarily without prior notice to you and where we cease to provide any of the Services, your licence to use such Services will be terminated or suspended automatically. Where we cease providing any of our Services, we will not be required to provide you with any refunds or compensation due to your inability to access or use such Services. We will stop billing the Periodic Recurring Payments to your Payment Method when your C2C program is no longer available online.
      • The quality of the display of the streaming videos and the download speed of digital materials may vary from computer to computer, and device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. All videos of a C2C program are hosted on a third party website such as Vimeo, Moodle or YouTube. You are responsible for all Internet access charges. C2C makes no representations or warranties about the quality of your watching experience on your display.
      • Customer Support. To find more information about our service and its features or if you need assistance with your account, you may also find it helpful to visit the Coach2Competence website page for more information or you can contact us by email at info@coach2competence.com or by phone at +32 475 74 73 18. In certain instances, we may best be able to assist you by referring you to our IT-support. In the event of any conflict between these Terms of Use and information provided by our IT-Support or other portions of our website, these Terms of Use will control.

     

  14. Your Conduct
  15. You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged, or impaired in any way. You understand that you are solely responsible for all electronic communications and content sent from you to us and you must use the Website for lawful purposes only.
    You must not use the Website for any of the following:

    • For fraudulent purposes, or in connection with a criminal offence or other harmful or unlawful activity.
    • To distribute, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing or in breach of copyright, trademark, confidence, privacy or any other right or is otherwise injurious to third parties or objectionable or which consists of or contains software viruses, Trojan horses, data scraping, keystroke logger, spyware, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam".
    • To cause annoyance, inconvenience or needless anxiety.
    • To obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website.
  16. Choice of Law and Jurisdiction
  17. These Terms shall be governed by, and construed in accordance with, Belgian law. You warrant that your use of the Website complies with any applicable law in your jurisdiction.
    The parties irrevocably agree that the courts of Mechelen (Belgium) shall (subject to the clause below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the Belgian courts.
    C2C shall retain the sole right to bring enforcement proceedings in your country of residence.

  18. Ownership, Copyright and Database Rights
  19. You understand and acknowledge that the C2C programs available to you have been developed or obtained by C2C by the investment of significant time, effort and expense, and that the programs are valuable, special and a unique asset of C2C which provides C2C with a significant competitive advantage, and needs to be protected from improper disclosure and use.
    Multi SkillZ is a C2C registered brand that may only be used when the party has a valid Multi SkillZ Academy License.
    You acknowledge and agree that C2C owns all rights, title and interest in and to the Licensed Property granted to you by your Multi SkillZ License Agreement. You will not challenge in any court of law or in any other manner the validity of the Licensed Property or C2Cs’ exclusive ownership of the Licensed Property. A membership of a program does not in any way result in any ownership of the concept. Offering the online service by C2C does not imply any transfer of intellectual property rights.

    In consideration for the receipt by you of any C2C program access, free or by paying, you agree as follows:

      • All copyright, trademarks, rights in databases and any other intellectual property rights which subsist from time to time in all text, copy, source code, images, sound, software, data compilations, service marks, logos, the C2C and Multi SkillZ name, the domains ‘coach2competence’ and ‘multiskillz’, and any other material featured on the Website ("the Content") are, as between you and C2C, owned by C2C, its affiliated companies or reproduced on the Site with permission of the relevant rights owner.
      • The contents of the Website may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without C2C’s prior written consent, except as stated below.

        You may read, view, print and download the Content for private and personal non-commercial use only provided that all copyright, trademark and other proprietary notices contained in or around the Content is retained, but you may not make more than one copy electronically or otherwise of any of the contents and you may not recopy or further distribute, sell, publish or transmit any part of the Content by electronic or any other means.

      • You may not systematically extract and/or re-utilise parts of the Content of the Website without C2C’s express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Website, without C2C’s express written consent. You also may not create and/or publish your own database that features substantial parts of this Website without C2C’s express written consent.

     

      • You agree not to sell, resell, supply or otherwise make the Content or extracts or other information derived therefrom available in any manner or on any media to any third party without the prior written consent of C2C.
      • You will not attempt to register the Content of the Website, alone or as part of your own service marks, trademarks, or trade names, in Europe or with any other governmental entity anywhere in the world. Except as expressly authorized by C2C in writing, you shall not use the Content or any similar Content as, or as part of, a trademark, service mark, trade name, fictitious name, company or corporate name, or Internet domain name anywhere in the world. In connection with its use of the Content, you will not in any manner represent that you have any ownership right in the Content, and you acknowledge that all use of the Content by you inure of the benefit of C2C.

     

      • No License. A membership to a C2C program does not entitle you to offer Multi SkillZ classes, training, camps or training under the name and brand Multi SkillZ, nor does the membership entitle you to the use of the  title of Multi SkillZ Coach (Trainer or Coach). To represent Multi SkillZ, you must be in possession of a written approval by C2C in the form of a Multi SkillZ Academy License Agreement. Online Membership does not give the user a license for commercial exploitation under the name and brand Multi SkillZ.
      • No permission for Training or Educational purposes. Multi SkillZ programs are online support programs designed to support you in delivering practical lessons for children. Your Membership does not grant you to train, educate or certify people in any way in the Multi SkillZ Method or to use a C2C program to do so. If you are an Education Institute, you can apply for online support for your students in the form of the Multi SkillZ StudentZ program. You agree not to use the service for public displays or the training of coaches, trainers, teachers or any type of supervisors.

     

      • You shall promptly advise C2C if you become aware of any possible unauthorized disclosure or use of the C2C material and/or programs.

    Following termination of your C2C program, your membership will automatically close at the end of your current billing period and the access to the platform will no longer be granted. All rights granted to you for use of the Content shall entirely revert to C2C, and you will cease from any and all use of the brand Multi SkillZ.

  20. Warranties & Liabilities
  21. C2C will not be liable to you through your use of the Website in respect of the following:

    • direct or indirect business losses (including without limitation economic loss, loss of profit, loss of business, loss of anticipated savings, loss of goodwill, loss of reputation);
    • indirect, special or inconsequential loss;
    • any loss (whether direct or indirect) arising from events outside of our control;
    • any loss (whether direct or indirect) in respect of loss of or corruption of data, database or software.

    C2C gives no warranty, expressed or implied, that the Website will function and be accessible at all times correctly as intended.
    The Content may contain inaccuracies or typographical errors. C2C makes no warranty that any statements or text within this Website is accurate and accepts no liability for any lack of accuracy therein.
    You accept that C2C gives no warranty whatsoever that use of this Website, including engaging in email correspondence with C2C and others and the downloading of files, will not expose your hardware and/or software to computer viruses, or worms, Trojan horses or other code of a damaging nature. It is your responsibility to put in place appropriate protections.
    C2C accepts no responsibility for the content and functioning of other websites that you may access through this Website or which are linked to this Website, nor does C2C endorse the content of such other sites.

  22. General
  23. Any failure by C2C to enforce any of its rights under these Terms & Conditions shall not be construed as a waiver of any of its rights herein.
    The waiver by C2C of a breach or default of any of the obligations hereunder by you shall not be construed as a waiver of any succeeding breach of the same or other obligations nor shall any delay or omission on the part of C2C to exercise or avail itself of any right power or privilege that it has or may have hereunder operate as a waiver of any breach or default by you.
